Terms of Service

These Terms of Service (hereinafter referred to as "Terms") set forth the conditions of use for "PainStream" (hereinafter referred to as "Service") provided by Hideya Yuda (hereinafter referred to as "Provider").

The Service operates as a Twitch Extension that enables viewers to use Bits or other Twitch virtual currency to control fitness machine parameters (including speed, incline, resistance, etc., hereinafter referred to as "Machine Parameters") in real-time for streamers using fitness equipment.

THIS SERVICE INVOLVES PHYSICAL CONTROL OF FITNESS EQUIPMENT. USERS MUST FULLY UNDERSTAND ALL PROVISIONS OF THESE TERMS (ESPECIALLY ARTICLE 4 REGARDING SAFETY GUIDELINES) BEFORE USING THE SERVICE.

In these Terms, "User" refers to any user of the Service (including both streamers and viewers). By using the Service, Users are deemed to have agreed to these Terms and the Privacy Policy. Please read these Terms and the Privacy Policy carefully before using the Service.

Article 1 (Application)

1. These Terms are intended to define the conditions of use of the Service between the Provider and Users, and shall apply to all relationships between the Provider and Users regarding the use of the Service.
2. Rules regarding the use of the Service posted by the Provider on the Service or the Provider's website from time to time shall constitute a part of these Terms.
3. In the event of any conflict or inconsistency between these Terms and Twitch's Terms of Service, Developer Agreement, or other policies (hereinafter referred to as "Twitch Policies"), Twitch Policies shall prevail.

Article 2 (Use of the Service)

1. The Service operates as a Twitch Extension, enabling viewers to use Bits to control Machine Parameters of a streamer's fitness equipment in real-time.
2. Use of the Service requires a valid Twitch account. Users shall authenticate through their Twitch account and comply with Twitch's Terms of Service.
3. The Service may only be used by those who comply with these Terms and applicable laws and regulations. If a User is a minor, they must obtain consent from a parent or legal guardian before using the Service.
4. When using the Service as a streamer, the streamer shall confirm their health condition and the safety of their fitness equipment, and use the Service at their own responsibility.
5. If the Provider determines that a User falls under any of the following categories, the Provider may restrict all or part of the features or suspend the use of the Service permanently or temporarily without prior notice to the User. The Provider shall not be obligated to refund any paid fees or Bits even if such measures are taken:

  (1) Violation of laws or these Terms
  (2) Being a member of or associated with anti-social forces
  (3) Damaging the Provider's credibility or interfering with the Provider's business through spreading false information, fraud, force, or other improper means
  (4) Having previously had their use of the Service suspended
  (5) Using the Service in a manner that threatens the safety of streamers or third parties
  (6) Any other case where the Provider deems suspension or other measures appropriate

Article 3 (Intellectual Property Rights)

1. Copyright, patent rights, trademark rights, and other intellectual property rights related to the Service belong to the Provider or third parties who have licensed them to the Provider.
2. Copyright and other intellectual property rights in content streamed through the Service (including video, audio, etc.) belong to the streamer who created the content or other legitimate rights holders.

Article 4 (Safety Guidelines and User Responsibilities)

THIS SERVICE INVOLVES PHYSICAL CONTROL OF FITNESS EQUIPMENT. USERS MUST FULLY UNDERSTAND AND AGREE TO THE FOLLOWING BEFORE USING THE SERVICE:

1. Streamers (fitness equipment users) shall comply with the following:
  (1) Before using the Service, confirm that their health condition is suitable for fitness exercise, including seeking medical advice if necessary
  (2) Confirm in advance that the fitness equipment being used is functioning properly and can be used safely
  (3) Immediately stop exercising if feeling unwell during use of the Service, and use the emergency stop function if necessary
  (4) Not set Machine Parameters exceeding the safety limits established by the Service
  (5) Not use the Service if suffering from heart disease, respiratory disease, musculoskeletal disorders, or other conditions that may interfere with exercise

2. Viewers shall be considerate of streamer safety and shall not use Bits with the intent of placing excessive physical burden on streamers.

3. The Provider establishes safety limits (such as maximum Machine Parameter values) in the Service, but does not guarantee that these limits are safe for all Users.

4. Users shall handle at their own responsibility any physical injury, health damage, equipment malfunction, or other damages arising from or in connection with the use of the Service.

5. The Service is not provided for the purpose of medical treatment, medical advice, fitness instruction, or rehabilitation. Users with health concerns should consult medical professionals.

Article 5 (Use of Bits)

1. Viewers may use Bits or other virtual currency provided by Twitch to send control requests for Machine Parameters.
2. The purchase, use, and refund of Bits are subject to Twitch's Terms of Service and policies. The Provider shall not be responsible for refunding the purchase price of Bits.
3. Control requests sent by viewers may not be reflected as intended due to Service system constraints, application of safety limits, network conditions, or other factors. Even in such cases, used Bits will not be returned.

Article 6 (Prohibited Activities)

Users shall not engage in any of the following activities or activities that may lead to them when using the Service:
(1) Activities that violate laws and regulations
(2) Activities that infringe on the intellectual property rights, reputation rights, privacy rights, or other legal or contractual rights of the Provider or third parties
(3) Activities that are contrary to public order or good morals
(4) Sending Machine Parameter control requests in a manner that intentionally threatens streamer safety
(5) Circumventing, disabling, or tampering with the Service's safety features (emergency stop function, safety limits, etc.)
(6) Unauthorized access to servers, IoT devices, or fitness equipment connected to the Service
(7) Placing excessive load on servers connected to the Service (including using automated means to send large numbers of control requests)
(8) Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code or communication protocols of the Service
(9) Unauthorized use of Twitch's API or violation of Twitch Policies
(10) Any other activities deemed inappropriate by the Provider

Article 7 (Display of Advertisements)

Users understand and agree that advertisements from the Provider or third parties may be displayed on the Service.

Article 8 (Handling of Collected Information)

1. The Provider shall handle Users' personal information appropriately in accordance with the Privacy Policy established by the Provider.
2. The Service collects user information through integration with Twitch accounts. Information collected includes Twitch username, user ID, Bits usage history, control request transmission history, and activity history within the Service.
3. The Service may collect and use data obtained from fitness equipment (including sensor data such as speed, incline, resistance, and heart rate) for the purposes of providing the Service, safety management, and service improvement.
4. The Provider may analyze and otherwise use information obtained regarding Users' use of the Service for the purposes of providing, maintaining, and improving the Service and other services provided by the Provider, planning and developing new services, and delivering advertisements on the Service and other services provided by the Provider.

Article 9 (Changes, Suspension, and Termination of the Service)

1. The Provider may change, suspend, or terminate all or part of the Service without prior notice to Users.
2. All or part of the Service may become unavailable due to changes in Twitch's platform, API, or policies. The Provider shall not be liable in such cases.
3. Integration between the Service and fitness equipment may become restricted or impossible due to specification changes, firmware updates, or other reasons by fitness equipment manufacturers. The Provider shall not be liable in such cases.

Article 10 (Disclaimer of Warranties and Limitation of Liability)

1. The Provider does not guarantee the normal operation of the Service and shall not be liable for any issues.
2. The Provider does not guarantee the accuracy, immediacy, or reliability of Machine Parameter control, and control requests may not be reflected as intended due to communication delays, equipment response delays, or other factors.
3. The Provider shall not be liable for any physical injury, health damage, mental distress, fitness equipment malfunction or damage, or any other damages arising from or in connection with the use of the Service. Users use the Service at their own responsibility.
4. The Provider does not guarantee that the Service does not infringe on the intellectual property rights or other rights of third parties, or that the Service is suitable for any particular purpose, and shall not be liable for any issues.
5. Users acknowledge in advance that all or part of the Service may become unavailable due to changes in the content or operation of external services (including but not limited to Twitch, fitness equipment manufacturer APIs, cloud services, etc.). The Provider shall not be liable for any damages incurred by Users in connection with external services.
6. Even if the Provider is liable for damages to Users, such liability shall be limited to actual direct and ordinary damages incurred by Users due to the Provider's breach of contract or tort, up to the amount paid by the User to the Provider in the past one month, except in cases caused by the Provider's intentional misconduct or gross negligence.

Article 11 (Changes to These Terms)

When changing these Terms, the Provider shall set a reasonable grace period before the effective date of the changed Terms and publicize the fact of the change, the content of the changed Terms, and the effective date in advance on the Service or the Provider's website. If Users use the Service after such publication, they shall be deemed to have agreed to the changes to these Terms.

Article 12 (Relationship Between These Terms and Laws)

If any provision of these Terms is deemed to be contrary to the Consumer Contract Act or other laws applicable to the contract between Users and the Provider regarding the Service, such provision shall not apply to the contract with Users to that extent. However, this shall not affect the validity of other provisions of these Terms.

Article 13 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
